Can You File a Personal Injury Lawsuit If You Were Partly at Fault?
Texas is one of several states to follow a comparative negligence rule when it comes to cases in which multiple parties share some of the fault for the injury-causing event. Under this rule, you may still file a claim and seek compensation for your damages if you were partly to blame. However, because Texas follows a modified comparative negligence rule, you cannot file a personal injury lawsuit if you were more than 50% at fault, meaning you were more at fault than the other party.

For example, if you are seeking $10,000 in damages after a car accident, and the court finds you 25% at fault for the crash, you could only recover up to 75% of that amount, or $7,500.
