When Should You File a Personal Injury Lawsuit?

If you have been seriously injured due to another person or party’s negligent or wrongful conduct, you should consider filing a personal injury claim or lawsuit. You are likely dealing with significant physical, emotional, and financial challenges as a result of your injuries. A successful personal injury claim can allow you to recover monetary compensation for your medical bills, lost income, future care costs, pain and suffering, and other damages.

However, the amount you can recover will be reduced by your percentage of fault. So, for example, if you are found to be 25% to blame for the incident that caused your injuries, you could only recover 75% of the total amount you are seeking in damages.

What Is the Statute of Limitations on Personal Injury Lawsuits in Louisiana?

Louisiana imposes a statute of limitations, or filing deadline, on all personal injury cases, meaning you only have a limited time to bring your lawsuit. With some limited exceptions, you have just one year from the date of injury to file a personal injury lawsuit in Louisiana. This means that, if you wait more than a year to file your lawsuit, the court will almost certainly dismiss your case, and you will be unable to recover any compensation for your injury-related losses.

One exception to the one-year statute of limitations involves the “discovery rule.” Under this rule, people who do not and could not discover their injuries right away have one year from the date on which the injury was discovered, or reasonably could have been discovered, to file a personal injury lawsuit. This rule commonly comes up in cases involving less-obvious injuries, as well as illnesses, occupational diseases, and various medical conditions.
